DIDSBURY – Two residents charged after a man was attacked on a Didsbury street in March 2018 have been found not guilty following a Court of Queen’s Bench trial in Calgary.
According to Alberta Justice, Jesse James Hoffman was found not guilty of conspiracy to commit murder and not guilty of aggravated assault, while Austin Cody Jay Graham was found not guilty of conspiracy to commit murder.
On March 16, 2018 a man was knocked unconscious outside a business in Didsbury. RCMP alleged at the time that there was a plot to kill the intended victim over a child custody dispute.
A third accused, Joseph Jerry Aubut, was found not guilty of aggravated assault and conspiracy to commit murder and guilty of assault causing bodily harm.
He was sentenced to six months in jail but given credit for 22 months pre-trial custody served, and ordered to pay $585 restitution. He was also handed a 10-year firearms prohibition.
A fourth accused, Donna Marie Faulkner, was found not guilty of conspiracy to commit murder and assault causing bodily harm.
A decision on a charge of aggravated assault will be handed down on April 6.
