A Mountain View County woman convicted in November of manslaughter in the Dec. 2010 shooting death of her 68-year-old husband has been released on $25,000 bail pending appeal.

Heather Wilson Duncan, 63, was convicted by an eight-woman, four-man jury on Nov. 26 and sentenced by Justice Allan McLeod to four years in prison.

Barry Alexander Duncan, 68, died of a single 12-gauge shotgun blast to the head on Dec. 10, 2010. The killing took place in the front room of the couple's Fallen Timber area acreage.

During Wilson Duncan's trial the jury heard that the couple were arguing a short time before he produced a shotgun and it went off.

Her lawyer, Jim Butlin, filed an appeal of the conviction with the Alberta Court of Appeal on Jan. 6.

As part of that appeal process, Wilson Duncan applied for interim bail release, which was granted Feb. 5.

Bail conditions include a reporting condition, the surrender of her passport, and an order to stay in Alberta.

"When we get the appeal records from transcript management, then the Court of Appeal will set a date for the appeal, with input from counsel,î Butlin told the Gazette.

Manslaughter is culpable homicide where there is no intent to kill, unlike second-degree murder which includes deliberation.
