Woman appeals conviction

A month after being sentenced to four years for the shooting death of her husband, Heather Wilson Duncan, 63, has launched an appeal of her conviction. Wilson Duncan's lawyer, Jim Butlin, filed the appeal with the Alberta Court of Appeal on Jan. 6.

On Nov. 26 an eight-woman, four-man jury convicted Wilson Duncan of manslaughter in the shooting death of Barry Alexander Duncan, 68.

Barry Duncan died of a single gunshot wound to the head at the couple's Fallen Timber home south of Bergen on Dec. 10, 2010.

Justice Alan McLeod sentenced Wilson Duncan on Dec. 10. She has been in custody since Nov. 26.

Butlin says he will be applying for bail for Wilson Duncan, who was tried on a second-degree murder charge but convicted of manslaughter.

During her three-week trial, Wilson Duncan testified that her husband was shot in the face with a 12-gauge shotgun following an argument.

"I was grabbing the gun and trying to take it away. Then he fell down,î she testified.
