MOUNTAIN VIEW COUNTY - A group of Bergen landowners are requesting a number of changes to the county’s Bergen area structure plan (ASP).
A petition signed by the landowners was received at the May 27 regularly scheduled council meeting, held by teleconference.
The request is to amend the plan by removing policies 7.1.1 and 7.1.2 that restrict residential subdivision in proximity to potential aggregate resources.
The landowners are within the areas defined between Twp. Rd. 324 and Twp. Rd. 314 and bordering lands between Rge. Rd. 51 and Rge. Rd. 52.
The landowners believe that future aggregate extraction in the subject area is highly unlikely due to existing development such as residences, pipelines and environmentally significant areas.
In a letter accompanying the petition, the landowners outlined their reasons for seeking the amendments.
“The removal of the conditions placed on these privately-owned lands would allow landowners to develop the land in a manner consistent with other landowners within the county with regards to such opportunities as first parcel out of unsubdivided quarters for an agricultural parcel, residential farmstead, country residential or any other developments and their location on the land as provided by the land use bylaw.”
“As most of the lands described in the area of potential aggregate extraction area are privately owned, there is no guarantee these lands would ever be considered for that purpose and as such should not be subject to conditions that limit activity that has such limited potential of occurring.”
Administration recommended that the request for the amendments be included in administration’s ongoing review of ASP compliance with draft municipal planning document policies and be considered at that time.
Council accepted the request as information and directed the planning department to include the request with the municipal development plan review.
