MOUNTAIN VIEW COUNTY - A refusal of a development permit for an industrial storage and warehousing facility south of Carstairs is being appealed by the applicant to the subdivision and development appeal board (SDAB).
The applicant filed the building permit request for industrial storage and warehousing - shipping containers, equipment and recreational vehicles on its 2.12 acre parcel zoned business park district in the Rainbow Highway Industrial Park between Highway 2 and Highway 2A.
“The applicant submitted a site plan displaying 227 parking stalls of various sizes, and this development is proposed for the storage of no more than 227 consisting of recreational vehicles, trailers, vehicles and up to 200 shipping containers,” administration said in a briefing note to the administrative subdivision and development approving authority.
On Feb. 11, 2025 the approving authority refused the proposed development, saying the applicant did not obtain written consent from all the landowners affected by the restrictive covenant on the site.
“The applicant is required to submit developer approval as a requirement of the restrictive covenant register on the title as instrument agricultural control guidelines. One of the restrictions is that all proposals have to meet the approval of Rainbow Highway Industrial Park Design Committee as established from time to time by the developer or, in the event of his demise, by all the owners of lots in the said lands.
“The applicant shall obtain written consent from all the landowners affected by the same restrictive covenant and submit the written consent.”
After the approving authority’s ruling, the applicant appealed the ruling to the SDAB, and the appeal hearing will be held in the county office on March 21.
During that hearing the SDAB may hear from the appellant, the administrative subdivision and development approving authority, adjacent landowners, and persons representing government department and other agencies.
