Legal Description: SW 36;33;4;W5m (122.72 Acres more or less) Title No: 121 286 813 Subject to the following encumbrances: As shown on current title (Mortgage #221 111 860 to be discharged). Includes: 20’ wide modular home with appliances, outbuildings, 3 grain bins, 2 sea cans, and heated 40x42 shop, all “as is”. RPR available upon request. Excludes: All wheat crop, if unharvested by closing, remains the property of the Seller and will be removed as weather permits but no later than April 30, 2025. Conditions of Tender: 1. Tenders to be in writing and in a sealed envelope which must be submitted on or before 12:00 noon, Thursday, October 31, 2024 to: MHR Law LLP Attn: Raylene M. Kloihofer #1-5401-49th Avenue, Olds Alberta T4H 1G3; 2. No conditions are to be included in or attached to the tender; 3. A Deposit of 5% of the tendered amount by way of Bank Draft or Money Order must be included with all tenders. Deposits shall be payable to MHR Law LLP “in trust”. Deposits will be returned to unsuccessful tenderers; 4. The closing date shall be at 12:00 noon, Friday, January 3, 2025; 5. All other usual adjustments, including property taxes, shall be made as of the closing date; 6. GST shall be applicable in this transaction and will be in addition to the tendered price unless the successful tenderer is a GST registrant; 7. The successful tenderer will be required to obtain title insurance to facilitate closing due to land titles delays; 8. The highest tender or any tenderer will not necessarily be accepted and acceptance shall be at the sole discretion of the Owner; 9. Tenderers are responsible for their own due diligence in the purchase of these lands as the lands, buildings, and chattels will be sold “as is” without any warranties or representations by the Owner; and 10. If a tender is accepted and the successful tenderer does not complete the purchase, the deposit shall be forfeited in full as damages.
