In administration’s ongoing effort to review and revise local legislation and policies, staff discovered the municipality did not have a framework for a bylaw enforcement officer, as required by the Municipal Government Act (MGA).
“I’ve prepared a bylaw for council’s review and hopefully approval,” Linda Nelson, chief administrative officer informed council during the July 30 meeting.
“Under the MGA, the bylaw must specify the powers and duties of the bylaw enforcement officers and it must also establish disciplinary procedures for misuse of power, including penalties and an appeal process.”
The proposed bylaw clearly meets the parameters outlined by provincial regulations, she said.
“Since our bylaw officer is a peace officer, he doesn’t actually fall into this bylaw, he goes under the provincial mandate?” asked Coun. Cheri Funke.
“Let me clarify that — he would also fall under this bylaw because he also does bylaw enforcement duties. But the peace officer portion is provincial,” said Nelson.
Council carried all three readings for the bylaw that will outline the municipality's steps for the provision of an officer’s appointment, empowerment, as well as discipline.
