OLDS - The Crown has launched an appeal of the acquittal of a man for allegedly pointing an imitation firearm at the production set of the Last of Us series in Olds in June 2022.
Olds resident Reece Wadden, 19, faced charges of mischief, possession of an imitation weapon for a purpose dangerous to the public peace, and use of an imitation firearm in the commission of an offence.
Justice Brian Stevenson found Wadden not guilty of all charges on April 4 following a trial.
Wadden was arrested and charged after a film crew member observed someone pointing what appeared to be a firearm out of a second-storey window adjacent to the film set of The Last of Us on 51st Street.
Crown prosector Alyx Nanji had argued that Wadden had “specific intent to cause mischief, based on actually using the imitation firearm, and his actions and inactions afterwards.”
Nanji described the imitation firearm as a BB gun that resembles an “AR-15-style firearm.”
In the notice of appeal filed April 12 and obtained by the Albertan, the Crown sites several grounds for appeal, including that the “learned trial judge erred in law in his decision being unreasonable and not supported by the evidence” and “such further and other grounds as counsel may advise and this Honourable Court may permit.”
The appeal will be heard in Court of King’s Bench on Aug. 3.
