Accused waives hearing

A 57-year-old woman charged after a Calgary woman was attacked and severely injured by two pit bulls in a Sundre trailer park last August will have her trial date set next month after she waived her preliminary hearing last week.

A 57-year-old woman charged after a Calgary woman was attacked and severely injured by two pit bulls in a Sundre trailer park last August will have her trial date set next month after she waived her preliminary hearing last week.

Rita Phillip, of Sundre, faces two counts of aggravated assault. She was scheduled to have her preliminary hearing in Didsbury provincial court on Feb. 6.

Calgary resident Deanna Wolfe, 26, suffered severe injuries, including the loss of an ear, when she was attacked by two pit bull dogs in a trailer in the Sundre Mobile Estates park shortly after 2 a.m. on Aug. 18.

Police says the dogs were owned by Phillip and Calgary resident Christoforos Zergoptis.

One of the dogs in question was shot and killed by a Sundre RCMP officer on the night of the attack, while the second dog was later euthanized.

Phillip, who remains in custody, is now scheduled to have her Court of Queen's Bench trial date set on March 22.

Each of the charges Phillip faces carries a maximum penalty of 14 years in prison.

Wolfe has launched a $300,000 civil lawsuit against Phillip, Zergoptis and the Town of Sundre.

The suit alleges, in part, that the Town of Sundre was negligent for failing to "ensure proper signage as stipulated by the bylaws, failing to destroy the pitbulls, failing to monitor the pitbulls once they were deemed dangerous.î
