Board rejects appeal

The Mountain View County subdivision and development appeal board has released its reasons for rejecting an appeal of an earlier municipal planning commission ruling that denied a development permit application for a proposed Sundre area gravel pit.

West Can Seal Coating Inc. has proposed starting up a 150-acre gravel pit operation one kilometre south of Highway 584.

In a release made public last week, the board cited two reasons for its decision, which was made on June 17:

• The board did not find “conclusive evidence to overturn the decision of the municipal planning commission.”

• The public consultations undertaken by West Can were “confusing to the public because of the ongoing voluntary amendments made by the applicant. In accordance with the (South McDougal Flats) area structure plan, the applicant was expected to conduct comprehensive public consultations providing the public with a final summary of their proposal prior to application to the municipal planning commission.”

On June 17 the board turned down the appeal of a May 2 municipal planning commission ruling denying a development permit application for the project.

The commission cited two principal reasons for its May 2 decision: “The application will affect the use and enjoyment of neighbouring properties” and “the application does not meet the goals and directions of the South McDougal Flats Area Structure Plan requiring the addressing of impacts and public response.”

Matthew Arnil, VP of West Can, did not immediately return a call seeking comment.

West Can could appeal the subdivision and development appeal board ruling to the provincial Court of Appeal on a question of law or jurisdiction.
