Five months after being convicted of second-degree murder in the death of an 18-year-old Olds College student, Jeffrey Leinen's appeal of his conviction and sentence is underway.

Leinen's lawyer appeared in Calgary Court of Appeal on Wednesday as part of the appeal process, setting an appeal hearing date of September 18.

Leinen was sentenced to 14 years in prison after being convicted by a jury following a three-week trial.

Nicholas Baier, 18, was killed when he was run down outside the Texas Mickey bar on October 29, 2010.

As well as second-degree murder, Leinen was also convicted of aggravated assault for running over and seriously injuring a second Olds College student on the same night.

In a notice of appeal filed with the court shortly after the conviction, Leinen's lawyer, Jennifer Ruttan, said the appeal is being made on a number of grounds, including that the “trial judge erred in law in her instruction to the jury, that the judge erred in law in her answers to the questions from the jury, that the verdict of conviction is unreasonable, and that the sentence is demonstrably unfit.”

Leinen is serving his sentence in the Edmonton Maximum Security Institution.
