The man charged in the bombing murder of Vicky Shachtay will have to wait a year for his preliminary hearing to be held.
An agent for Brian Malley's lawyer appeared in Red Deer provincial court on Sept. 19 to confirm the dates for the hearing. It will be three weeks long and held Sept. 9-27, 2013, in Red Deer.
A preliminary hearing is an optional event that has a judge determine whether or not there is enough evidence to proceed to trial. A judge and jury trial was selected if the matter proceeds past the hearing.
Malley is facing three charges: first-degree murder, causing an explosion likely to cause serious bodily harm, death or damage to property and sending or delivering to a person an explosive device.
He was released on $10,000 bail after an Edmonton court appearance on June 28.
Shachtay was a 23-year-old single mother who died after opening a package delivered to her Innisfail apartment Nov. 25, 2011. The package was triggered to explode.
She was confined to a wheelchair as a result of injuries sustained in a 2004 motor vehicle accident. She reportedly received an insurance settlement as a result of the accident.
Family confirmed at a press conference on May 28 that Malley had been handling Shachtay's finances. Malley was an adviser with Assante Capital Management.
The Investment Industry Regulatory Organization of Canada is investigating Malley's past investment dealings.
